Terms of Use
Version 3.0
Draft for approval. This text was prepared for review and approval by FCA and has not yet been published.
1. Acceptance and scope
By accessing this system, or by submitting an enrolment form through it, you agree to these Terms of Use and to our Privacy Policy. They apply to everyone who uses the enrolment system and partner portal of Fredericton Christian Academy ("FCA"). Partners accept the Terms of Service and the Privacy Policy the first time they sign in; the other legal documents are shown to them for acknowledgment.
2. Who may use the system
Access is intended for FCA-accredited educational partners and their authorized representatives, FCA staff, school users, and students' families who receive a personal link from FCA or from a partner. Each person uses only the access that was given to them.
3. Authorized use
This system is intended solely for the international student enrolment process at FCA. You may use it only for that purpose and in line with the law.
4. Prohibited conduct
You must not:
- access, or try to access, accounts, files or data that are not yours;
- bypass, test or interfere with the security of the system, or introduce malicious code;
- copy data in bulk by automated means, or copy, reverse engineer or resell the system;
- use data obtained through the system for purposes unrelated to the enrolment;
- submit unlawful content, or pretend to be another person or organization.
5. Accuracy of information
You declare that all information provided is true, complete and up to date. Submitting false or incomplete data may result in the refusal or cancellation of the enrolment and in civil and/or criminal liability.
6. Partner responsibilities
The educational partner is responsible for:
- Making sure that student and guardian data was collected with the explicit consent of the parents or legal guardians
- Not sharing access links or personal links with unauthorized third parties
- Keeping confidential the information received through the system
The detailed obligations of partners are in the Terms of Service.
7. Families and personal links
Families open their forms through a personal link, which is meant only for the family that received it. The link expires after 14 days and can be renewed by the person who sent it. Do not forward it to others. If you think a link was seen by someone else, tell us at once.
8. Documents and deadlines
The partner agrees to provide all required documentation within the deadlines set by FCA. Late or incomplete submission of documents may delay or prevent the processing of the enrolment.
9. Intellectual property
All content of this system (layout, texts, forms, templates, trademarks) belongs to Fredericton Christian Academy or its licensors. Reproduction without express authorization is prohibited.
10. Availability and third-party content
We make reasonable efforts to keep the system available, but we do not guarantee that it will be uninterrupted or error-free. Some pages show content from other services (fonts, videos, images); those services have their own terms.
11. Suspension of access
FCA may suspend access to the system when there are signs of unauthorized access, a serious breach of these Terms, false information, or when the law or the security of the system requires it. For partners, the conditions and the notice are set out in the Terms of Service.
12. Limitation of liability
To the extent the law allows, FCA is not liable for indirect or consequential damages arising from the use of, or the inability to use, this system, including technical failures beyond our control. Nothing in these Terms limits liability that cannot be limited by law, or the rights that families and data subjects have under the law.
13. Changes to these Terms
FCA may update these Terms. The date of the last update is shown at the top of the page. When a change is relevant, partners are asked to accept the new version of the Terms of Service and of the Privacy Policy the next time they sign in, and are notified of changes to the other legal documents. Continued use of the system after a change is published means you accept the updated Terms.
14. Relationship with other documents
For partners, the Terms of Service and the partner agreement prevail over these Terms if they differ. Cancellations and refunds follow the Cancellation and Refund Policy and the Letter of Acceptance. Personal data is handled as described in the Privacy Policy.
15. Language
These Terms are available in English, Portuguese and Spanish. The English version prevails if the versions differ, unless mandatory law in your country requires otherwise.
16. Governing law and jurisdiction
These Terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada that apply in it. The courts of New Brunswick sitting in Fredericton, Canada, have jurisdiction over any dispute arising from these Terms. The parties do not agree to arbitration. Nothing in this section removes rights that you cannot waive under the mandatory consumer-protection or data-protection law of your country.
